Virginia’s Health Care Freedom Act Upheld
The Middle Finger of the Apocalypse to Obama and his healthcare plan. Virginia passed a law saying that no one in the state of Virginia is required to purchase healthcare. Then Obama passed the health care overhaul and asked that the Virginia law be dismissed. A Federal judge said no way.

Federal judge Henry Hudson has refused to dismiss a challenge from Virginia on the constitutionality of the individual mandate in ObamaCare. The case will have to move to trial, and could imperil the entire overhaul:
A judge on Monday refused to dismiss the state of Virginia’s challenge to President Barack Obama’s landmark healthcare law, a setback that will force his administration to mount a lengthy legal defense of the overhaul effort.
U.S. District Judge Henry Hudson refused to dismiss the state’s lawsuit which argues the law’s requirement that its residents have health insurance was unconstitutional, allowing the challenge to go forward.
Ken Cuccinelli said that this law is unconstitutional because it requires people to purchase something strictly so they can be therefore regulated by Congress under the commerce clause. Proud to be a Virginian today!
I LOVE MY STATE!!!! Technically… if you’re compelled to get healthcare and in some cases for free, then doesn’t that compel someone to provide it FOR FREE? hmmmmmmm?!?!?! AKA Slavery? I don’t know, I’m just saying… seems awful fishy to me that the NAACP and the ACLU isn’t all over this… Where the hell is Jesse Al when you need them>
Whoah, way too soon. The Virginia Health Care Freedom Act has not been upheld, and neither Obama nor anyone else has asked that it be “dismissed.”
You seem to be confusing the Act passed by the General Assembly with the lawsuit filed by the Attorney General. Two totally different branches of government.
