Evidence Tossed in Lunatic Nowak Case
An astronaut drives cross country with plans to kidnap and maybe murder the lover of a former boyfriend and the judge tosses the evidence because the tape recorder the police used for the interview sucked. Sheesh, what a lucky psycho bitch.
From Local 6 here, which also has a video:
A Central Florida judge tossed key evidence found during a search of a car belonging to former NASA astronaut Lisa Nowak’s and statements she made to Orlando police after her arrest on kidnapping charges.
Orange County Circuit Judge Marc Lubet accuses the Orlando Police Department of illegal activity when Nowak was interrogated.
Nowak drove from Texas to Florida so she could confront her romantic rival, Colleen Shipman. Both were believed to be dating the same man, astronaut Bill Oefelein. Nowak was arrested at Orlando International Airport in February and charged with attempted kidnapping and burglary with assault.
During Nowak’s interview with police, she claimed she requested a lawyer. However, the detectives’ tape recorder could not pick up much of the audio.
A detective denies that Nowak asked for an attorney and also said Nowak gave permission to search her car.
A jury will not see the evidence unless the state wins an appeal of the judge’s order.
She still has to go to trial, but I think the prosecution is severely hamstrung if it can’t show data or use her statements. I hope they succeed on their appeal.
